Grrrr

So my friend who has been facing court got sentenced today. He got 100 months in jail and lifetime probation.

I find this reprehensible. He would have got less time if he had actually molested someone.

The judge said he showed no remorse until now, but that simply isn't true. He got physically ill the day he read the charges. He said how much he regretted what he did, and how he wondered how the actual people in the images were doing, and yet the judge ruled that no one really wondered about the victims.

I have to wonder about the judicial system that after he says how sorry he is, says he hasn't considered the victims.

I feel the judicial system has failed. I find that the judge did not really consider his statement. I find that judge reallt did not consider all the facts, ad that he had a ruling long before he even got up to say a word.

Life stinks, and so does the judge.

So, here is the outcome of Court

Well, I finished up my case yesterday and had to laugh, which I will tell you at the end of this post.

First of all, I won the argument of whether or not to have the doctor testify. The prosecutor said I did not give notice to have an expert witness. However the judge ruled, that although I may not have filed a notice, that because the reason we did not finish last time was because the doctor could not appear, then the prosecutor had notice.

I also made the prosecutor look like a moron as he kept pushing the fact I had opiates in my urine. Although even the lab results said it was probably given to me in the ambulance. And the doctor even said that it could cause the behavior, it could not have caused the lab results, which would also cause the behavior. It was nice to note that all the witnesses, even the ones for the defense said there was something wrong with me. So at the end of the day, the judge really could not see that I was of sound mind.

So the result was, I was found guilty of careless driving, illegally crossing the median and driving without insurance. I was found not guilty of resisting arrest and obstructing an officer. I had to pay 485.00 in fines, and 12 points on my license. The part that made me laugh, is I would have plead guilty to that at the beginning and took the fines and points if they hadn't tried to keep pushing the probation. So I took two days of the court and prosecutor's time, to get exactly what they could have had without the fight, if they had just thought about it.

Oh well, there is our legal system at work.... or at least that is how I see it now.

I am going to Court

I just couldn't accept a plea bargain that had me on probation for 12 months. Even un-supervised. But there have been some good things

The doctor is going to appear, and they have decided to waive the appearance fee, since I have no money. My entire case turns on whether or not I was competent to knowingly resist arrest or obstruct an officer or anything else. With the doctor appearing, I can show that.

News on my Court

Well, I sent all my medical reports to the prosecutor and he looked them over. He hs finally agreed to drop everything except the careless driving. The only bad part is he wants me to be on unsupervised probation for a year. He says it is because he wants me to be evaluated for substance abuse and mental health. I am waiting for him to call back so I can offer that we postpone the trial one more time, and I will go get evaluated, and if it turns out, like I expect, that I have no substance abuse problems or mental health issues, that we let it go.

We'll see.

Birthdays Suck

I have not got to spend any time with anyone on their birthday this year, and no one wanted to spend time with me on mine.

On Ivan's birthday, I was unconscious. That sucked, but yeah, I wasn't able to call or text or for that matter even remember that it was his birthday.

My birthday, We had no money and no car, and Pet's paypal account had been hacked, so he had no access to his money, so he couldn't even afford gas to come over, not to mention that I had court the next day on my accident, and I had just figured out that I had missed the court date on one ticket. I ended up sitting in the bath tub feeling sorry for myself.

Pet's birthday, he went and spent with another guy, and then his family. I got to see him the next day, and had a party for him, but I just wasn't important enough to spend his actual birthday on.

And now Kit was in Virginia for his birthday, and it was bad enough that I didn't get to see him, but every time I tried to all him he was busy. Our longest conversation was 7 minutes, and we didn't talk for over 20 minutes the entire day. And he did exactly what I said he would do earlier in the day, We had a couple of planned phone calls, his would be first, then mine. I said he would tell me after my call that he was tired and was going to bed. He said no he would talk to me, well during my other call he texted me that he was going to lay down and would call me in a bit. I finally called him at 11:00 his time, and no answer, he called back, asked if I called, I said yes, we were going to chat, but you wanted to lay down. Oh I was watching a movie, now I am tired and going to bed. So I don't even know what he did for his birthday....

Birthday's at least this year, suck.

I don't understand it

If I tell someone "X", then you better believe I am going to do "X" or there had better be a good reason why I did not do "X". This especially goes for calling people. If I tell you that I am going to call you right back, you can figure that sometime in the next 20 minutes at the outside I am going to call you back. That doesn't seem to be the case with anyone else.

Case in point, I was talking to my pet (human pet, not bow wow) last night. I called up because I was having a rough time and needed someone to talk to. We talked for maybe a minute and he said he was going out to get food, and could chat in a bit. I said ok, and I am still sitting here waiting for that bit to be over. And that has been over 15 hours ago. Now, he has some metnal problems, that cause short term memory loss, and I could almost say ok to that, except he isn't the only one.

They guy who is supposed to be working on our cars, was supposed to call me at about 8:30AM Friday morning. I waited and waited and waited, and never got a call from him. So I have been trying to call him since Friday afternoon, and he has yet to answer his phone, from 8:00 to 11:00 PM, nothing, nada, zilch.

My boyfriend Kit is just the same. He tells me he is busy and will call me back in a bit, I will finally call him after 3 or 4 hours. That goes on til bedtime, when all the sudden I get a 1 minute call to say he is going to bed and he will talk to me the next day. This has happened for just about the entire month and a half that he has been in Virginia. We had one good call, but that was because I told him we would talk, and it would be a long conversation and to just plan for it.

But really, it is things like this that make me feel unimportant. I am not important in anyone's life, that they can even think of putting their life on hold to talk to me. Oh well, enough ranting for now, besides, its not like anyone ever reads this dribble anyway.

Depressed

So I haven't been updating this blog recently, because I have been going through a horrible bout of depression. It all stems from my perception that everyone I love leaves me. Sometimes they leave me because they want to, and sometimes it is forced, but still, everyone seems to leave me.

It all started with my mom dieing in 1999. I know that death is an inevitable part of life, and everyone dies, but I was really close to my mom, but it was even more than that. Before my mom died, we had a pretty close family. I talked to my mom and dad several times a week, sometimes every day. Holidays were always spent together. My mom's favorite holiday was Thanksgiving, and we always had a huge meal, and lots of family time. After mom died, our family just fell apart. I don't ever see anyone in my family anymore. The last time I saw dad was for his 75th birthday two years ago, which I planned. And still didn't get the whole family there. My nephew decided he couldn't go. I talk to dad on the phone, oh ever 2 or 3 months now. He has a new wife, and a new set of kids and grand kids, and it just doesn't seem like we are his family now. So not only did my mom leave me, but my whole family did.

The second person was our first pet, as in slave boy not bow wow. I loved him a lot. He came to the house all the time. When he was in college out of town, he would still come back, and come see us before he even went home. Then he moved here, and we saw him all the time. Well at my boyfriend's birthday party I introduced him to this other guy, and they hit it off. I didn't mind that he found someone he loved, it was more the fact, that in one fell swoop, he was no longer our pet. He didn't say goodbye, or anything, just left our lives. It hurt for a long time. I wasn't sure I could ever accept anyone again.

Then we met Kit. Kit came to live with us, because his step dad found gay porn on his computer, got extremely angry, put him through a brick wall, breaking 6 ribs, put him in the car, drove him to Denver and threw him out. We met him, and he told us his story. My heart went out to him, and the fact that he was living on the street then. We took him to the house, gave him a bed, and food. Sure enough, we both fell in love with him. HE became our second pet. He was our pet until my boyfriend had to leave for a while, when he became a part of our love triangle and was our boyfriend. I love Kit deeply. I care for him more than he will ever be able to even fathom. He went to Virginia on March 1st for a temporary job, that is still going on, and we have no clue when it will be over. I feel abandoned, I know he needed to do this, and I know the job that he is doing is one that he loves a lot, but I still feel abandoned.

And finally is my new pet. HE is a great guy, I love him too. But in the month that Kit went to Virginia, and I really needed some support and comfort, I only got to see him 3 times the whole month. He was busy or sick, and I felt abandoned again. I don't know why.

So through all this, I have become very despondent. No, I am not suicidal, and am not the suicidal type, I just feel like the whole world has abandoned me and went on their merry way, while I sit here missing everyone.

So anyway that is why I haven't updated this blog recently, I don't know when I will get back to posting all the time, maybe sometime soon. I hope you guys will check back from time to time, to see if I am here. I hope when I do return, that I actually get someone to comment on these. I love to hear other peoples ideas on what I am saying. That's all for now

A fun post

So I am usually pretty serious here, and I apologize for not updating recently. I have been going through an extreme bout of depression, and I will post about that next. I just thought I would give you guys a little bit of fun here and tell you some of the great rumors that have been spreading about me.

1. I had sex with ever male professor at CU Denver. This may be my all time favorite. I have never been to CU Denver, and don't know any male professors there.

2. I had sex with everyone at RMFC last year. Ok, guys, I know I am good, but geesh... Truthfully I did have sex at RMFC, with 5 people.

3. I have a drawer full of "Property of Kahuki" pet tags for making people into my pets. I have had three pets in my life. The first left me for a guy I introduced him to, the second became a boyfriend, and the third is still my pet. I wish I knew where that drawer was, cause I keep promising my current pet I will get him a tag.

4. While drunk and in the hot tub at RMFC, I molested a minor. OK, that one kind of hurt. It was a back stabbing effort to get me to resign as MAAC CEO. Let me just put it this way, even if I did what I was accused of, and I did talk to the person who accused me, it wasn't molestation, and he wasn't a minor. I was never, NEVER drunk in the hot tub and I do have witnesses to that fact, and in fact, I did not nibble on this guys neck. He is straight, and I am very considerate of straight guys, I will flirt, but that it is. No touching, and no nibbling their necks, or anything.

So that is the top four rumors that are being spread about me. I wish my life was even a quarter as interesting as the rumors that go around about me.

This last will and testament will probably not be signed, but is verified by the fact that I will email it to my two boyfriends, Marcus Sletten and Zachary Page on April 5th, 2011. I will also post it to my blog at www.as-i-see-it-now.com.

I leave all my wordly possessions, including the mortgage insurance to Marcus Sletten and Zachary Page, equally split among them. The only major possession I have is the house, the rest still goes to them, to be split any way that they see fit. If either doesn’t survive me, then it goes fully to the other person.

Religion in America

I haven't talked much about religion in these posts, but felt it was finally time to tell you all what I think.

First a little background. I was raised in a very religious home. My father had his license to preach, my brother had his license to preach, I even had a license to preach. I even pastored a small church for a short time while I was going to college. I was very involved in the music ministries, both playing instruments and singing and directing the choir. But I always felt out of place, like I didn't belong. Don't get me wrong, I love music, and I love playing the bass, and that was always enjoyable, but being 30 and unmarried, I always felt like people were looking at me funny. I dated a few girls, and every one of them went totally wrong. I even almost married one girl, but that was mostly because I felt her son needed a father figure. She was a complete mental case, but that was beside the point. When I quit the church, it was because they found out I like guys more. I was celibate at the time, but that didn't matter much to them. I was told I would never be allowed to be part of the platform ministry, that I would always be a background player. That didn't bother me too much, except for the fact that a girl who was going to the church, was 8 months pregnant with her third child, all out of wedlock, and by different fathers was allowed to do all the things I wasn't. She was allowed to sing specials, and be part of the worship teams. I just couldn't take the hypocrisy anymore. So my views on religion are slightly jaded.

I see religion in America as a way to control the people. We have quit following the teachings of Jesus Christ in order to push our more conservative views on everyone. I know it seems strange to say that Jesus was not conservative, but according to most modern teachers, he wasn't. He ate and slept with tax collectors and prostitutes, he hung around with a bunch of guys that were not preachers, but fishermen and other mundane occupations. And he taught us that there were only two rules for being a Christian. Love Gos, and love your neighbor as yourself. We go on to Paul's teachings and find that he put a lot more restrictions on being a Christian. The main one most people preach is you can't be gay. He also told us that women should be silent in the church. That if they have any questions, they should wait until they get home and ask their husband. Quite a change from what happens today. We have woman preachers, teachers, and ministers, and every one thinks that is great. Now don't get me wrong, I actually have nothing against woman preachers, I just feel if we are going to get so adamant about one teaching, then we need to follow them all.

We even see that in the teachings in the Old Testament. We see that there is a restriction against homosexuality in the laws, and we preach that fervently. However, that same list of laws tells us not to eat pork, or shell fish, that we should not cut our hair or beards, and that we should not wear clothes of blended cloth. The only one we still preach is no homosexuality. If we actually look at the scriptures and the times in which they were written, we can understand why God was telling us that. He had a group of people that he was trying to keep alive and thrive. In those days, if you ate pork or shellfish, you could die. If you cut your hair or beard, you could get heat stroke in the desert, and yes, if you slept with someone of your own sex, then you didn't produce off spring, and you wouldn't thrive. Well, we have thrived enough. We have a huge population explosion. We have more people than the Earth can really sustain, and we need to cut down. So the rule against homosexuality should go the way of the rules against eating and cutting your hair. It was good for the time, but no more.

I believe it is time for the Christians in this society, to really get back to the teachings of Christ. I believe we need to realize that word christian means one who is Christ like, and that we need to start manifesting the Spirit of Christ, and quit bickering about the things that he didn't see as important. Or at least, that is as I see it now.....

Age of consent

Sorry for not posting yesterday, but it was my friend Phillip's 21st birthday, and we were having his party at my house, so I had to prepare, but it got me thinking about today's post.

So what is it about age that suddenly makes us responsible. For some reason at midnight at on our 21st birthday, we suddenly become responsible enough to by alcohol. What is it that changes in our brain chemistry at the one sudden moment that makes us different. Is it suddenly we are responsible? Or is it that it gives us control over the masses?

Is it the same with sex? We teach our children from the earliest ages that they have the right to say no to someone touching them where they don't want to be touched. We teach them the difference between good touch and bad touch, but while we give them the right to say no, we don't give them the right to say yes. We tell them that until they are 18, or whatever the age is in that state, that they don't know the difference, and that they should say no to everyone. We tell them that they don't know what good touch is.

And while I agree that we should teach our children about sex, if we are going to give them rights over their body, then we need to give them rights. Now, I am in no way approving of molesting children, and I hope you are not getting that idea. What I am saying is that every person is different. I have met people in their 20's that cannot distinguish between good sex and bad sex. So why can there not be teenagers that have the maturity to distinguish between good sex and bad sex. I will say, I do not know the answer to this one. I don't know how we change our laws to give all citizens, no matter their age, the inherit rights that all people should have. Or at least, that's as I see it now.....

The Internet and Politics

So, how has politics changed over the last few years. I get several emails daily from my father, a died in the wool republican who thinks that Obama is the devil incarnate. But, I have to wonder why he feels this way.

All of these emails he gets are from the republican party. There is every lie in the book coming into his email, and since he gets these from "reputable" source so they must be true. He thinks that every email that comes his way is the absolute truth. He thinks that Pelosi told the government that she had to have this better plane to fly back and forth, when the truth is, the Secret Service told her that she had to have this plane because she had to be able to fly without stopping for fuel, and this is the only plane that could do that. But the republican party says otherwise, so that is what he believes.

Obama doesn't have a birth certificate, unless it serves their purpose, then all the sudden there is a birth certificate that says he was born in Hawaii. And why does he think this, because he gets it in his email.

So what is the change I am talking about. All the sudden the American public has access to all the propaganda of both parties. There is suddenly an influx of information coming straight to their inboxes with no contradictions to show their inaccuracy so the public believes it all. Now I am not saying that we need to have a public blocking of all information. But I do think we as the people who gets this information has the responsibility to see it for what it is. It is our responsibility to look at this information and see it for what it is, and not spread it all over the globe. Or at least that is as I see it now....

President's Day

Here we are in the United States of America celebrating President's Day. The day we actually celebrate the lives of George Washington and Abraham Lincoln.

Let's look at these men and see what we can learn. First George Washington.

On April 30, 1789, George Washington, standing on the balcony of Federal Hall on Wall Street in New York, took his oath of office as the first President of the United States. "As the first of every thing, in our situation will serve to establish a Precedent," he wrote James Madison, "it is devoutly wished on my part, that these precedents may be fixed on true principles." He was also actually opposed to the party system of government. According to the White House Biography, "To his disappointment, two parties were developing by the end of his first term. Wearied of politics, feeling old, he retired at the end of his second. In his Farewell Address, he urged his countrymen to forswear excessive party spirit and geographical distinctions. In foreign affairs, he warned against long-term alliances." I wish we had learned from this man, and swore off excessive party spirit.

And now for Abraham Lincoln. Lincoln never let the world forget that the Civil War involved an even larger issue. This he stated most movingly in dedicating the military cemetery at Gettysburg: "that we here highly resolve that these dead shall not have died in vain--that this nation, under God, shall have a new birth of freedom--and that government of the people, by the people, for the people, shall not perish from the earth." Well, we seem to be losing that government of the people, by the people, We are now government of the party, by the party until the next party wins.

So here we are celebrating the lives of two men that had great expectations for this country. And let me say, I have great expectations for this Country too. I talk a lot about the bad things that are happening in this country, but I do love it. I do think we have a great thing going. But we do need to make some changes. We need to follow the words of George Washington and look out for the party system. We need to heed the words of Abraham Lincoln when he called this government of the people, by the people and for the people. Then and only then can we once again become the great nation we once were, and get back on track. Or at least that is I see it now.....

We're throwing our rights away

I have long been a proponent of constitutional rights, and feel that our rights should be protected above all else. Even when I worked in the public defenders office in New Mexico, part of my job was helping to find reasons to get obviously guilty people off on reasons that their rights were violated. And I did that gladly. If there was a search that didn't follow the rules, then the evidence should be thrown out. I faced a lot of criticism because of that. Especially when it was known that I helped get drug dealers off because the police didn't do something as simple as call the judge and ask for an extended search warrant. Now what I read in the Colorado law, really irks that wish for the rights to be protected.

Apparently in Colorado, if there is a case of unlawful sexual contact of a child, the hearsay rule is thrown out. What this means, is that if there is a child that has been touched inappropriately, and they tell Joe that daddy touched me there, then Joe can go to the Courts and testify that the child said that daddy touched me there, and it will stand. Now I am not saying, and please don't read this to mean that I think that child ought to be abused, but I feel that we have made laws to protect everyone for reasons, and that if we start making exceptions like this, we are on a slippery slope, that leads to the destruction of our country.

Don't get me wrong, I am not just against laws that affect sex offenders. We have something in this country that was passed under the great tutelage of George Bush called the patriot act. The patriot act says in part that if you are suspected of being a terrorist, the government can come pick you up, take you into custody and hold you there until they see fit to do something with you. All of your constitutional rights are thrown out the door. The right to a speedy trial, the right to fair and reasonable punishment, all of it is thrown out the door. They also have the right to monitor your phone without any intervention from anyone. Even though, there is a special court already set up for them to go to request a wiretap. The government at that time felt that was too much trouble, they just want to do the wiretaps without telling anyone. Oh, and these were finally repealed recently.

Anyway, the whole point of this post is that we as a country need to protect our freedoms. We need to guard against the government saying that we don't deserve those protections. or at least that is as I see it now....

I wanna be rich

I was sitting today watching "The Social Network" which is about Mark Zuckerberg, the founder of facebook. And I was immediately drawn to the story. I was impressed how he took a simple idea, and has since made it into a 25 Billion dollar industry. As a matter of fact, I bet everyone either has a facebook, or at least knows someone who has a facebook. That's a lot of people. But that isn't where it stops.

Let's look at Microsoft. Microsoft is now a multi-billion dollar industry. Most Americans have access to at least 2 computers running a microsoft product. I say at least 2 because we all have computers at home, and probably at work. And that computer at work is probably connected to another computer running a microsoft product or two. Let's see, we have windows and office on most computers, and internet explorer. And people get mad at Bill Gates, they say he is running a monopoly, but is he really. First of all, there is no requirement that we have a computer. And if we do have a computer, there is no requirement that it run windows. As a matter of fact, a lot of people I know would rather run something like Linux on their system. And we can do that, we can run Linux if we want to. So why does it seem that everyone runs windows? Because it is simpler. Because Bill Gates had the foresight to have his developers make something that my father can use. And he used that to his advantage. I don't think he runs a monopoly, I think he is probably the smartest marketer in the USA. I don't want to bad mouth Bill Gates, I want to be Bill Gates.

So as the title of this blog says, I wanna be rich, and I don't apologize for that. While I realize that money cannot buy happiness, or so we are told, I do know that money can buy a lot of the things that buy happiness. And while being rich isn't everything, being poor sucks. I used to say that I really didn't want to be rich as much as I just wanted to pay my bills. I see the futility of that now, and fully admit, if I could come up with an idea that would make me a billionaire, then you better believe I would do it. As the popular song goes, I wana be a billionaire, so freaking bad. I wanna buy cars like Bentley's and Aston Martins. I wanna live in a mansion, and I wanna provide an exceptional life for my two boyfriends, and my pet. And while I don't see a lot of socio-political ramifications in this post, I just want you guys to know this. Watch for me on the cover of Time magazine sometime in the future. Or at least, that's as I HOPE to see it now....

Crime and Punishment in the USA

So, one of the founding principles of our society is the punishment of those that go against our morals and beliefs. We also believe that our citizens should be protected against excess punishment, and that the punishment should match the crime. Well I have several ideas that would help in the punishment area.

First of all, I think that all general intent crimes should immediately be made un-constitutional. Why you may ask. I don't think you should be punished for a crime that you didn't have the criminal mind to commit. So I think we should have two basic levels of criminals. Those who intend to commit a crime, and thus know that they are going to have a punishment for it. Say, murder in the first, or well any murder, assault battery, you know things where you know you are hurting someone else, and don't care. And maybe criminal history should play a part, but it should be looked at in the whole picture. So take my case for example. Yes, I have a criminal history, but was 19 years ago, and has absolutely no bearing on the present case.

So I think that punishment should match the crime, and that crimes should have a specific intent, and that if you can't form specific intent for what ever reason, then you shouldn't be held as a criminal. Or at least, that's as I see it now....

Another Fun Day in Court

So, I went to court today, and once again, I was bullied by the prosecutor. Let me explain.

Original ticket, excuse me, tickets, was careless driving, illegal crossing of a median, failure to provide insurance on one ticket and resisting arrest and obstructing an officer on the other ticket. The prosecutor said he would drop the careless driving on the one ticket and the resisting arrest on the other ticket. No jail time, but 8 points on my license, fine and probation. Yes, they want to put me on probation. And he said, if I didn't agree today, then he would fine the charge for leaving the scene of an accident, and add it. That would be a 12 point fine. So, for having a bout of viral meningitis, I am facing 24 points on my license. I have not had so much as a parking ticket in over 7 years.

Now the main reason the prosecutor did not want to drop the obstruction was because he didn't think I was sick, and because I have a criminal history. My criminal history is over 19 years old. So, how does that have an effect. So I came home and looked up the statute for obstructing an officer. It reads, and this is for Westminster, "6-5-5: OBSTRUCTING A POLICE OFFICER:

(A) It shall be unlawful for any person, by using or threatening to use violence, force, physical interference, or obstacle, to knowingly obstruct, impair or hinder the enforcement of the penal law or the preservation of the peace, or the placement or attempted placement of a person into custody for purposes of his own safety and welfare or the safety and welfare of others, by a police officer, or any person duly empowered with police authority. (1224 2001 2031)

(B) It is no defense to a prosecution under this Section that the police officer, or any person duly empowered with police authority, was acting in an illegal manner, if he was acting in the regular course of assigned duties and in good faith based upon surrounding facts and circumstances. (1224)

(C) It shall be unlawful for any person to refuse to reveal their correct name, address and date of birth when requested to do so by a police officer, or any person duly empowered with police authority, engaged in the investigation of any violation of law, traffic accident, disaster or other event. (1224)

(D) Obstructing a police officer is a criminal offense, punishable by a fine or imprisonment, or both, as provided in Section 1-8-1 of this Code. (2001)"

There was no violence, there was no lieing to the officer, as a matter of fact, I could not even speak intelligently, so I don't see how I could have withheld evidence. So, where exactly do I fit in the obstruction statute. And the fact that I had viral meningitis should have some bearing. And if I wasn't sick, then why was I put in the back of an ambulance and not the back of a police car? Yes, I feel like I am being bullied to get his win ratio up. Oh, and I also found this in the Westminster statutes...

6-2-13: OBSTRUCTION OF THE SEEKING OF EMERGENCY ASSISTANCE: (3119)

(A) It shall be unlawful for a person to knowingly obstruct or otherwise interfere with anyone who is seeking medical, police, fire or other emergency assistance from any person or agency, public or private.

(B) Obstruction of the seeking of emergency assistance is a criminal offense, punishable by a fine or imprisonment, or both, as provided in section 1-8-1 of this code.

So, if I was seeking emergency care, then why isn't the officer charged with obstructing me seeking emergency care. Oh wait, he is a police officer, and he doesn't have any reason to help me seek emergency care. All he needs to do is arrest me, and get his ratio up.

Am I little biased here? Well probably. But I hate being rail roaded into a guilty verdict when I am not guilty. There is something in the legal industry called mens rea. It means the guilty mind, or the ability to form a criminal intent. Since I could not even speak intelligently, how the hell could I form the criminal intent. The Officer says that all I said to him was "I can't get in trouble, I can't get in trouble" Now, you have been reading my blog for a while now, so I ask you.... Do I seem like the type of person that when talking to an officer would only tell him "I can't get in trouble" As a matter of fact, I asked the prosecutor that same question, and all he could tell me is he is no judge of normal. If he is no judge of normal, then why the hell is he a prosecutor. If most of our law is based on the presumptions of what would a normal person do, then shouldn't he be a judge of what is normal or not normal. Or at least that is how I see it now....

It's Friday again

Well here it is Friday. The end of the week. My God, are the weeks getting shorter or not? Sometimes they feel like they are, and sometimes not.

One of our roommates moved out this week. I wish him all the best. He is trying to get back into the Army after don't ask don't tell. We'll see how that goes. I personally think that gays should be allowed to serve openly in the military. Now, before you get all huffy and say "But what if they watch me in the shower, or want to fondle my man bits"? Well they didn't watch you in the shower or fondle your man bits before they were allowed to be open, so you guess.

Also, I am going to the doctor today. No, I am not dieing. I have asthma, and have had it for many many years. Now they are telling me that I am using too much ventolin and that obviously my asthma is uncontrolled. Well that may be, but I am also unemployed, and uninsured, and now have to pay my doctor 75.00, or more appropriately my physician's assistant 75.00 just so they can give me more prescriptions I can't afford and renew the ventolin which I can afford 1 can a week, and that is about what I use. So now I have to pay more and more money that I can't afford, for a cure that is not going to work, but it is the only way I can keep the medicine that can work. Go figure.

So, maybe this hasn't been the most intelligent blog I have put out, but it is the things I am feeling right now, or at least that's as I see it now....

As Courts Go....

This one wasn't too bad. The judge found that I was in compliance so finally my property is clean enough for Arvada. I still find it wierd that the city can tell me how clean my backyard is supposed to be. But let's look at other laws where they invade our privacy and maybe we'll see the pattern.

One of my favorites is the seatbelt law. If I drive a vehicle or ride in the passenger seat, I am required by law to wear a seatbelt. And if I don't, I can get a ticket. And they pull me over just because they don't see a seatbelt. Now don't get me wrong, I believe in wearing seatbelts. I think they save lives. But I also believe I have the right not to have my life saved if I don't want it saved. And on the same note, if I ride a motorcycle, I am required to wear a helmet. Now again I think helmets save lives, and I would never dream of riding a motorcycle without a helmet. But, once again, I must save, if I don't want my life saved, then what the hell type of government do we have that can trample all over my rights as an individual and tell me that I have to do things that are going to save my life.

I am sure if we looked closer at several laws we would find that several of them don't pass the constitutional muster. And what do we do? We simply roll over and say well if our government says so, it must be right. We don't dare question the authority. I say it's time to look closely at what our government is telling us, and tell them that we want laws that protect us, not break us. Or at least, that's as I see it now....
